Prosecutors Seek to Block Testimony in Gun Case
JACKSON, Miss. (AP) - Federal prosecutors want to prevent a man from telling jurors that he stayed out of trouble for years before being arrested in 2012 during a search for a fugitive.
Royce Funchess was arrested Aug. 7, 2012, when authorities were searching his house for Robert Lee King, suspected of fatally stabbing his ex-girlfriend and wounding her daughter in Memphis, Tenn., in 2005.
Funchess was charged with pointing a gun at the officers.
A mistrial was declared May 1 in Funchess' first trial when the jury couldn't reach a verdict.
Prosecutors say Funchess testified during that trial that he'd stayed out of trouble since a 1998.
But prosecutors say that wasn't true, and Funchess was arrested in 2007 for possession of marijuana and a gun.
He is scheduled for retrial Nov. 12.
