Indiana Fugitive in Loxley Back in Court
BALDWIN COUNTY, Ala. (WPMI) An Indiana fugitive arrested in Loxley's latest effort to avoid a trial has failed.
A judge denied the motion by Aaron Massey's lawyer to dismiss charges of rape, kidnapping and unlawful imprisonment.
Massey was found with a 38-year-old woman and her child in a Loxley motel in May. Police say the two were held against their will.
Kristy Redenbaugh has since changed her story and says Massey is actually her husband.
Massey's attorney said because the two are married, it's not a crime.
"It's always been our contention that they just had a kinky sex life. It doesn't really amount to criminal charges if he enjoyed it too," said Rachel Powell, Massey's attorney.
Massey will now wait to have his case heard before a Grand Jury. He could still face charges in Indiana, as well as federal kidnapping charges.
