UPDATE: Kyser Miree's father, Ben Miree was the last prosecution witness to take the stand this morning. Local 15 New's Darwin Singleton described the testimony as "very emotional" with many in the courtroom weeping as Miree recalled the moment he learned his son was shot.
(MOBILE, Ala.) - Day three of testimony is underway in Mobile County Criminal Court in the Michael Lee murder case. Lee, and three others are charged with capital murder in connection with the shooting death of 23-year-old Kyser Miree.
Miree was killed in his Midtown Mobile home in April, 2010 during a robbery.
Tuesday, three other suspects in the case told jurors the gun went off accidentally as Lee hit Miree in the head with a gun.
Wednesday morning, the prosecution called two forensic experts to testify about the wound to Miree's head. The experts contradicted the previous testimony saying the shot was fired one inch or more away from Miree's head. Prosecutors say this proves the shooting was no accident.
The prosecution rested its case Wednesday.
